Richard M. Loftis, Esq., has been an active trial lawyer since 1975, and specializes in family law and probate litigation. Mr. Loftis attended University of Florida for two years, was honorably discharged after serving as a medic in Viet Nam, 1968-1969, and finished his B.A., cum laude at Georgia State University with a major in psychology and a minor in Latin. Mr. Loftis received his Juris Doctor from Emory University School of Law in December, 1974. He is admitted to all Georgia trial and appellate courts, the United States 11th Circuit Court of Appeals and the United States Supreme Court. He is a member in good standing of the State Bar of Georgia, family law section, the Atlanta Bar Association and the Gwinnett Bar Association, family law section. He is married to the former Charlotte Anne Reaves of Jacksonville, Alabama, who is a psychotherapist with the Veteran’s Administration. They have five children and seven grandchildren.

Mr. Loftis:
As a sole practitioner, this firm is better able to provide individual attention for individual problems than a larger firm. Every family law case is different, and personal attention provides efficient and cost-saving analysis of specific needs. I have tried many cases in my thirty-four years of practice, both jury and non-jury, and I don’t need to try another one needlessly. I strongly encourage settlement if at all possible and regularly use settlement conferences, mediation and arbitration as alternatives to more costly trials. However, it takes both parties to provide the benefit of settlement, and if we do not receive that cooperation from the other side, or if it is not appropriate in a particular case, I have no hesitation whatsoever to tenaciously fight for you and protect your rights, as a parent and a divorcing spouse, in a trial of all issues before the court or a jury.  
 
I am very child oriented in my practice, and I believe most courts are also, or they certainly need to be. I regularly make use of guardians ad litem, psychological and custody evaluations if economically feasible.
 
If not, I will make the appropriate motions and do whatever possible to have the court provide these services cost-free.
Kids

It is of utmost importance to have children protected from violence, substance abuse, immoral atmospheres, and less safe environments. They must be provided with the very best atmosphere for their health and welfare. In addition, I am keenly aware of the potential for parental alienation in divorce and custody disputes and I work closely with noted psychologists and therapists to weed this destructive influence out and stop it.
 
Whether it be a case involving only division of assets, a custody case, or one laced with physical or mental abuse, I feel my thirty four years in the courtroom give me the wisdom you require to assist you in calm and reasoned decision making. One of my jobs is to take as much of the legal burden of these unfortunate circumstances off your shoulders, so you can cope with those personal issues which are required to allow you to move on to better and safer times. I have the ability and experience to handle all of your family law needs, from the management of a complex marital property dispute, to the sensitive advocacy needed in an emotionally charged child custody matter. I have the time for you and pride myself in returning calls or emails as quickly as possible to answer your questions or receive information from you.
 
My firm also has extensive experience in trust and probate litigation. Many times after the death of a loved one, there are questions or problems in the distribution of an estate, or questions concerning the fairness and veracity of the administrator, executor or trustee. I have handled litigation and trials in these areas on numerous occasions.
